§ 1 Scope of application & provider identification

1. These GTC apply to all orders placed by customers via the Mokiartgallery.de online store.

§ 2 Formation of the contract

1. The presentation of goods in the online store does not constitute a legally binding offer, but an invitation to order.
2. By clicking the “Buy” button, the customer submits a binding offer to purchase the items contained in the shopping cart. The purchase contract is concluded when we accept the order by sending an order confirmation by e-mail.

§ 3 Data protection

The collection, processing and use of personal data takes place exclusively within the framework of the statutory provisions of data protection law. You can find more information on this in our [Datenschutzerklärung]

§ 4 Right of withdrawal for consumers

Consumers have the right to withdraw from the contract within 14 days without giving reasons. The withdrawal period begins on the day on which the customer or a third party named by the customer takes possession of the goods. § 5 Delivery of the goods

1. Delivery within Germany and to Austria is carried out by HDL.
2. The delivery time is usually 3 to 5 working days.
3. Delivery within Germany and Austria is free of charge.

§ 6 Payment, due date, retention of title

1. Payment can be made by credit card, PayPal or bank transfer.
2. The purchase price is due upon conclusion of the contract.
3. The goods remain our property until the purchase price has been paid in full.

§ 7 Warranty

The statutory liability for defects shall apply. In the event of defects, customers are entitled to subsequent performance (rectification of defects or replacement delivery). If the supplementary performance fails, the customer may withdraw from the contract or reduce the purchase price.

§ 8 Compensation

Claims for damages are excluded, except in cases of intent or gross negligence.

§ 9 Choice of law, place of performance, place of jurisdiction

1. German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
2. The place of performance for all services arising from the business relationships existing with us is our registered office.
3. The place of jurisdiction is our place of business if the customer is a merchant, a legal entity under public law or a special fund under public law.

§ 10 Miscellaneous

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
